Welcome to NiqueCo LLC. These Terms & Conditions govern purchases made through our website, the use of our website, and services provided by NiqueCo LLC.

By placing an order or booking a service after being given reasonable notice of these terms and an opportunity to review them, you agree to the applicable Terms & Conditions.

Please read them carefully before making a purchase.

1. ABOUT NIQUECO LLC

NiqueCo LLC is a Virginia-based business offering artistic merchandise, personalized gifts, custom-designed products, photography services, and original artwork through our BEYOND collections.

Our products may include tumblers, mugs, home décor, keepsakes, printed artwork, and other specialty merchandise.

We serve customers throughout the United States.

2. PRODUCT INFORMATION

We make every reasonable effort to accurately represent our products, including their designs, colors, dimensions, materials, and features.

Please understand that:

Colors may vary slightly due to differences in screen settings, printing processes, and materials.
Handmade and personalized products may have minor variations.
Artwork placement may differ slightly between products.
Product availability and specifications may change.

These minor variations do not necessarily constitute defects. However, this provision does not excuse products that are defective, incorrect, or materially different from their descriptions.

3. ALL SALES ARE FINAL

ALL SALES ARE FINAL.

NiqueCo LLC does not accept voluntary returns, exchanges, refunds, or cancellations due to:

A change of mind.
Personal preference.
Ordering the wrong product, design, or size.
Incorrect personalization information supplied by the customer.
Minor color variations attributable to normal screen and printing differences.
Other reasons unrelated to a product defect, fulfillment error, or applicable legal right.

This policy applies to standard merchandise, BEYOND collection products, personalized items, custom orders, and made-to-order merchandise.

Legal Exceptions: This final-sale policy applies to voluntary returns, exchanges, and cancellations. It does not waive any applicable express or implied warranty, statutory cancellation or refund right, or other remedy required by federal or state law.

If an item arrives damaged, defective, incorrect, or materially different from its description, please contact us so we can review the issue and provide an appropriate resolution consistent with applicable law.

4. PERSONALIZED & CUSTOM ORDERS

Customers are responsible for providing accurate personalization information, including names, dates, photographs, wording, and design preferences.

Please review all submitted information carefully before completing your purchase.

For custom orders requiring design approval, customers may receive a digital preview.

Approval confirms acceptance of the visible design details, including spelling, layout, and personalization.

Once an order has been submitted, changes or cancellations are not guaranteed. Once production begins, modifications may be unavailable.

Any additional design or revision charges will be disclosed and agreed upon before they are incurred.

All custom orders are subject to our All Sales Are Final policy and applicable legal exceptions.

5. CUSTOMER-SUPPLIED IMAGES & CONTENT

Customers who provide photographs, artwork, logos, text, or other creative materials represent that they own the content or have the necessary permission to use it for the requested purpose.

Customers agree not to submit materials that infringe another person's intellectual property, privacy, publicity, or other legal rights.

NiqueCo LLC reserves the right to decline projects involving unlawful, inappropriate, or potentially infringing content.

Customer-supplied materials will be used in connection with the requested services and handled in accordance with our Privacy Policy.

6. ORIGINAL ARTWORK & BEYOND COLLECTIONS

BEYOND is an artistic collection offered by NiqueCo LLC, featuring seven distinct Worlds:

ADORE — World of Beauty
ORBIS — World of Wonder
NEXORA — World of Connection
ASCEND — World of Growth
VELORIS — World of Admiration
LEGACY — World of Love & Remembrance
RESTORED — World of Hope

NiqueCo LLC retains the intellectual property rights it owns or is legally entitled to exercise in its original branding, designs, artwork, photographs, and creative materials.

Purchasing a physical product does not transfer ownership of the underlying intellectual property.

Customers may not reproduce, redistribute, or commercially exploit protected NiqueCo LLC materials without appropriate authorization.

7. DESIGN METHODS & CREATIVE TOOLS

NiqueCo LLC may use original creative direction, digital illustration, photography, editing software, AI-assisted design tools, and other artistic techniques in developing its products.

Finished designs may undergo artistic review, refinement, and production preparation.

Certain designs may incorporate licensed, third-party, or AI-generated elements subject to separate intellectual property rights or limitations.

NiqueCo LLC claims intellectual property protection only to the extent available under applicable law.

Purchasing a product does not automatically grant access to editable design files, source files, or production materials.

8. PRICING & PAYMENT

All prices are displayed in U.S. dollars unless otherwise stated.

Payment is required before an order enters production unless a separate written agreement provides otherwise.

Additional charges for customization, special materials, design revisions, or services will be disclosed before the customer agrees to them.

Applicable taxes, shipping costs, and other mandatory charges will be disclosed before checkout is completed.

NiqueCo LLC reserves the right to correct genuine pricing errors. If an order is canceled because of such an error, any payment collected for the canceled order will be refunded.

9. ORDER PROCESSING & SHIPPING

NiqueCo LLC ships merchandise throughout the United States.

Processing times depend on product availability, customization requirements, production schedules, and order volume.

We make reasonable efforts to fulfill orders within the shipping timeframe advertised at the time of purchase.

If no shipping timeframe is provided, we will follow applicable federal requirements, including the general 30-day shipping rule.

If we cannot ship an order within the applicable timeframe, we will provide the notices, delay-consent options, cancellation opportunities, and refunds required by the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule.

Estimated carrier delivery dates may vary due to circumstances outside our control.

Customers are responsible for providing accurate shipping information.

Additional shipping charges may apply when an order must be reshipped because of incorrect or incomplete customer-provided information, subject to applicable law.

If a package is lost, damaged, or not delivered, please contact us so we can investigate and provide any remedy required by law.

10. RETURNS, REFUNDS & EXCHANGES

All sales are final.

We do not offer voluntary returns, exchanges, or refunds for change-of-mind purchases.

11. PRODUCT CARE & USE

Customers should follow the care instructions provided with their products.

For sublimated drinkware, recommended care may include:

Hand washing with mild soap and a soft sponge.
Avoiding abrasive cleaning products.
Avoiding prolonged soaking.
Not placing products in the microwave.
Avoiding dishwasher.

Failure to follow appropriate care instructions may affect product appearance or longevity.

This section does not exclude remedies for manufacturing defects or other rights protected by law.

12. PHOTOGRAPHY SERVICES

NiqueCo LLC may offer portrait sessions, custom photography, printed photographs, and related creative services.

Photography bookings are subject to the applicable booking agreement or written confirmation.

Session fees, deposits, payment schedules, cancellation conditions, rescheduling policies, and delivery timelines will be disclosed before the customer agrees to them.

Any nonrefundable deposit or fee must be clearly identified and agreed upon before it applies.

Photography services may have separate contractual terms that govern the specific booking.

13. PHOTOGRAPHY IMAGE RIGHTS

Unless otherwise agreed in writing, the photographer or other lawful copyright owner retains applicable copyright ownership in photographs created during a session.

Customers receive the usage permissions stated in their photography agreement or accompanying license.

Commercial reproduction, resale, or distribution beyond the granted license may require additional permission.

NiqueCo LLC will not publicly use identifiable client photographs for promotional purposes without an appropriate legal basis or authorization.

14. ORDER CANCELLATIONS

Because NiqueCo LLC offers merchandise that may be produced, customized, or prepared specifically for each purchase, orders are considered final once submitted.

We do not guarantee voluntary cancellations after an order has been placed, even if production has not yet begun.

Customers may contact us promptly to request a correction or cancellation. We may accommodate a request at our discretion when operationally possible.

This provision does not restrict cancellation or refund rights required by applicable federal or state law, including rights arising from qualifying shipping delays or unfulfilled orders.

Photography cancellations are governed by the applicable photography booking agreement.

15. INTELLECTUAL PROPERTY

NiqueCo LLC retains the rights it lawfully owns or controls in its original branding, BEYOND collection identities, artwork, designs, website content, product photography, and other creative materials.

Unauthorized copying, reproduction, distribution, or commercial exploitation of protected materials is prohibited.

Third-party trademarks, images, and other intellectual property remain subject to their respective owners' rights.

16. WEBSITE USE

Customers agree to use our website for lawful purposes.

You may not attempt to interfere with website functionality, gain unauthorized access to systems, distribute malicious content, or use our services for unlawful activities.

NiqueCo LLC reserves the right to decline transactions or restrict access where reasonably necessary to prevent fraud, abuse, or unlawful conduct, subject to applicable law.

17. THIRD-PARTY SERVICES

Our website may use third-party service providers, including Shopify, payment processors, shipping carriers, and technology platforms.

These providers may maintain separate terms and privacy policies.

NiqueCo LLC is not responsible for the independent conduct of third-party providers except to the extent responsibility is imposed by applicable law.

Nothing in this section removes NiqueCo LLC's own legal obligations to customers.

18. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, NiqueCo LLC will not be liable for indirect, incidental, special, or consequential damages arising from use of our website, products, or services.

Nothing in these Terms & Conditions excludes or limits liability for fraud, willful misconduct, or any other liability that cannot lawfully be excluded or limited.

This provision does not eliminate any nonwaivable consumer rights or remedies.
